Consent to Establish vs Consent to Operate (CTE and CTO)

If you are starting a factory or any unit that can pollute, the State Pollution Control Board will ask for two separate permissions. They have similar names and people mix them up, but they apply at different stages of the project.

CTE is the permission to set up the unit. You need it before you start construction or install machinery. The Board looks at the proposed site, the activity and the pollution control arrangements you plan to put in. It is issued under Section 25 of the Water (Prevention and Control of Pollution) Act, 1974 and Section 21 of the Air (Prevention and Control of Pollution) Act, 1981.

CTO is the permission to run the unit. You apply for it after the plant is built and the pollution control systems are installed, but before commercial production starts. The Board usually inspects the site, checks the treatment systems and asks for test reports on effluent and emissions. The legal basis is Section 26 of the Water Act and Section 21 of the Air Act. Operating without CTO is an offence, and the Board can issue closure directions.

How the category changes things

The Central Pollution Control Board sorts industries into red, orange, green and white categories according to their pollution potential. Red units face the strictest process, including a site inspection and shorter consent periods, while green units have lighter requirements. White category activities are treated as non-polluting and generally do not need CTE or CTO, though an intimation to the Board may still be needed. Lists are updated from time to time, and each state board runs its own online portal, so check the current list for your activity and state.

Renewal

Consents are issued for a fixed period that depends on the category and the state, so you have to renew before expiry with fresh test reports and proof that you complied with the conditions. Late renewal can mean a gap during which you are operating without valid consent.
