Clinical Establishment Registration in Haryana

Clinical establishment registration is the licence a hospital, nursing home or diagnostic centre needs under the Clinical Establishments (Registration and Regulation) Act, 2010. In Haryana it covers establishments with more than 50 beds and diagnostic laboratories and imaging centres. What it is

A clinical establishment is any place that offers diagnosis, treatment or care for illness, injury or pregnancy. Hospitals, maternity homes, nursing homes, clinics and diagnostic centres all qualify, whether a single doctor, a trust, a company or the government runs them.

The law is the Clinical Establishments (Registration and Regulation) Act, 2010, a central Act that Haryana adopted. It was notified in the state on 4 April 2018 and is worked through the Haryana Clinical Establishments (Registration and Regulation) Rules, 2018, amended in 2019. Applications go online on the national portal, clinicalestablishments.gov.in, and are decided by the District Registering Authority, chaired by the Deputy Commissioner.

It happens in two steps. First comes a provisional certificate, issued without inspection. Permanent registration follows once you prove you meet the minimum standards for your category.

Who it applies to

Hospitals with more than 50 beds

From 4 April 2018, all therapeutic and diagnostic establishments in Haryana with more than 50 beds, public or private, across every recognised system of medicine, including allopathy, AYUSH and others.

Diagnostic labs and imaging centres

From 14 March 2019, establishments offering laboratory or medical-equipment diagnostic services, such as pathology labs, X-ray, ultrasound and scan centres, were brought in.

Not covered today

Establishments of the armed forces are excluded by the Act. Haryana has not yet extended registration to clinics and nursing homes with 50 beds or fewer. Here is the catch: a 40-bed nursing home that adds a wing and crosses 50 beds comes in on that day.

Why it matters

It is a legal condition to operate

Section 11 says no one may run a clinical establishment unless it is registered. Skip it and Section 41 penalties apply.

Insurers and panels ask for it

Insurers, third-party administrators and government health schemes ask for your licences when you apply for empanelment. This certificate sits near the top of that list.

It sets the standards you are judged by

Section 12 ties registration to minimum standards on facilities, staff and records, and to stabilising emergency patients within your capacity. Meet them early and inspection is routine.

Section 15 requires the authority to issue it within 10 days, with no inspection beforehand (Section 16). Display it where patients can see it.

Answer objections and host the inspection

The evidence is displayed for 30 days for objections. The inspection team includes the Civil Surgeon and a representative of the district Indian Medical Association.

Collect the permanent certificate

Once cleared, you receive a certificate valid for five years. We diarise the renewal the same day.

Timelines

Provisional certificate

Issued within 10 days of the application. Particulars are published within 45 days. Valid for 12 months; renewal is due 30 days before expiry (Section 17).

Permanent registration

Evidence is open to objections for 30 days. Haryana’s rules give the authority 15 days to decide once the required evidence is in.

Renewal and appeal

Permanent registration lasts five years; apply for renewal within the six months before expiry (Section 30). An appeal against refusal lies within three months under the Haryana rules.

What happens if you skip registration

Fines of up to ₹5 lakh for running unregistered

Section 41: up to ₹50,000 for the first contravention, up to ₹2 lakh for the second and up to ₹5 lakh for each later one. Anyone knowingly working there can be fined up to ₹25,000.

Fines for obstruction or false information

Section 42: up to ₹5 lakh for disobeying directions, obstructing the authority or giving false information. Section 43 adds up to ₹10,000 for minor deficiencies that are not corrected.

Your registration can be cancelled

Under Section 32 the authority can cancel registration after a show cause notice. Where patients face imminent danger, it can stop operations at once.

Fees are paid by demand draft to the District Registering Authority. Government and local-authority establishments are exempt. In practice, a 120-bed trust hospital in Faridabad pays ₹3,000 now and ₹12,000 at the permanent stage.

Frequently asked questions

Does my small clinic in Faridabad need clinical establishment registration?

Not at present, if it has 50 beds or fewer and runs no diagnostic lab or imaging. Haryana applied the Act to establishments with more than 50 beds from 4 April 2018 and to diagnostic laboratories and imaging centres from 14 March 2019. A clinic with its own pathology lab or ultrasound may fall in the diagnostic category. We check your setup against the current notification and give you a clear answer.

Which law governs clinical establishment registration in Haryana?

The Clinical Establishments (Registration and Regulation) Act, 2010, a central Act adopted by Haryana, together with the Haryana Clinical Establishments (Registration and Regulation) Rules, 2018. The rules were amended in 2019 to add fees for diagnostic establishments. Section 11 bars running an unregistered establishment and Section 12 sets the conditions. How long does the provisional certificate take?

Section 15 requires the authority to issue it within 10 days of receiving a complete application. Section 16 says no inquiry is held before provisional registration, so there is no inspection at this stage. The certificate is valid for 12 months and must be renewed 30 days before it expires. A complete file keeps you inside the 10 days.

What is the fee for a 100-bed hospital?

A hospital with 51 to 100 beds pays ₹2,000 for provisional registration and ₹8,000 for permanent registration under the Haryana rules. Hospitals with 101 to 300 beds pay ₹3,000 and ₹12,000. Fees are paid by demand draft in favour of the District Registering Authority. Government-run establishments are exempt. How long is permanent registration valid?

Five years from the date of issue, under Section 30 of the Act. Apply for renewal within the six months before expiry; a late application costs an enhanced fee. Provisional registration, by contrast, runs for 12 months at a time. We track both dates for you and start the renewal file early, so the certificate never lapses.

What is the penalty for running without registration?

Under Section 41, up to ₹50,000 for the first contravention, up to ₹2 lakh for the second and up to ₹5 lakh for every later one. Staff who knowingly work in an unregistered establishment can be fined up to ₹25,000. Say a Ballabgarh diagnostic centre has run since 2020 without the certificate. Who inspects the establishment before permanent registration?

Under the Haryana rules, the inspection team includes the Civil Surgeon and the President or a representative of the district Indian Medical Association. Your evidence is also displayed for 30 days for public objections, and you get to reply to any that come in. Can the application be filed online?

Yes. Haryana requires online registration on the national portal, clinicalestablishments.gov.in, with the fee paid by demand draft to the District Registering Authority. Do I still need a fire NOC and biomedical waste authorisation?

Yes. Clinical establishment registration does not replace other approvals. A hospital typically also needs a fire NOC, biomedical waste authorisation from the Haryana State Pollution Control Board, a drug licence for an in-house pharmacy, and PC-PNDT or AERB approvals for ultrasound or X-ray equipment.
