What it is

When people ask for a tobacco licence, they usually mean one of three things: a Tobacco Board registration, a trade or retail licence from the local municipal body, or the general registrations any trader needs, such as GST. There is no one certificate that covers all of them.

Tobacco products are also regulated by the Cigarettes and Other Tobacco Products Act, 2003 (COTPA). The Act does not issue business licences. It sets the rules on sale, advertising and packaging that every licence holder must follow.

Who it applies to

Dealers, packers and exporters

The Tobacco Board registers dealers in tobacco, packers, exporters of unmanufactured tobacco and tobacco products, and processors and commercial graders of Virginia tobacco. Registration runs on a calendar year.

Retailers and wholesalers

A kirana store in Faridabad or a distributor usually deals with the local municipal body for a trade licence, where one is required. Rules and fees differ by city, so we check with your local body first.

Manufacturers

What happens if you trade without the right approvals

Penalties under COTPA

Selling to anyone under 18, or within 100 yards of an educational institution, attracts a fine of up to ₹200 under Section 6. Tobacco advertising under Section 5 can bring up to two years in prison, a fine of up to ₹1,000, or both, for a first conviction.

Packaging violations

Producers who break the Section 7 packaging rules face up to two years in prison, a fine of up to ₹5,000, or both, for a first conviction. Sellers and distributors face lower penalties.

Local action

Municipal bodies can act against premises or refuse renewal when a required licence is missing. A lapsed Board registration can also hold up export dispatches.

Can I export tobacco without the Board registration?

Is GST registration compulsory for tobacco traders?
