Fertilizer Licence: Dealer Registration under the Fertiliser Control Order
A fertilizer licence lets you sell fertilizer legally. Under the Fertiliser (Control) Order, 1985, no one may sell fertilizer without the registration or authorisation the Order requires, and it runs for three years. What it is
The fertilizer licence is the common name for a dealer's authorisation under the Fertiliser (Control) Order, 1985, made under the Essential Commodities Act, 1955. Clause 7 says nobody, whether manufacturer, wholesale dealer or retail dealer, may offer fertilizer for sale except under the registration or authorisation the Order requires. State governments may exempt sales to farmers in notified areas.
The paperwork differs a little by dealer type. A wholesale or retail dealer files a Memorandum of Intimation in Form A1, in duplicate, with the fee and a certificate of source in Form O. The notified authority acknowledges it in Form A2, which counts as authorisation. An industrial dealer applies in Form A and receives a certificate of registration in Form B. We check which route your state office follows, since each state notifies its own authority and fee.

Say you are opening an agri-input shop near a mandi. It sells urea, DAP or complex fertilizer to farmers needs its authorisation in place before the first sale.

Industrial users and traders
Businesses buying fertilizer for industrial use apply as industrial dealers in Form A, with registration in Form B.
Why it matters
You can sell without risk
Selling without the required registration breaches an order under Section 3 of the Essential Commodities Act, which attracts penalties under Section 7.
Suppliers expect it
Manufacturers and wholesale suppliers ask for your certificate of source and authorisation before they open or keep an account with you.

What happens if you sell without a licence
Penal action under the Act
Breach of an order made under Section 3 of the Essential Commodities Act, 1955 is punishable under Section 7.
Stop-sale notices
An inspector can issue a stop-sale notice. Under clause 28 of the Order, the inspector must start further action within 21 days or the notice is revoked.
No renewal after idle years
The Order says a certificate will not be renewed if no fertilizer was sold in the preceding year, so a dormant shop can lose its place.

How long does the grant of registration take?
For an industrial dealer, the registering authority must grant the certificate in Form B within thirty days of receiving the application, unless a ground for refusal applies. Refusal grounds include a recent suspension or conviction, a missing source certificate or an incomplete form. A complete file helps you avoid delay.
What is the government fee?
The Order leaves fees to the state government, within maximums fixed by the Central Government. The amount therefore differs by state and dealer class. We confirm the current fee with your district agriculture office before filing and quote it separately from our own fee, so there are no surprises.
Can a licence be renewed if I made no sales?
Not normally. The Order says a certificate is not renewed if no fertilizer was sold in the preceding year. If your shop had a slow year, tell us early. We review your sales records and advise you on the right way to apply for renewal.
Does a fertilizer licence cover pesticides and seeds?
No. Pesticides are covered by the Insecticides Act and need a separate licence, and seeds follow seed law. Many agri shops hold all three. We can apply for them together so that your stock list, shop registration and GST details stay consistent across every application.
