Expedited Trademark Registration: Faster Examination Under Rule 34

Expedited trademark registration means asking the Registrar to examine your application on a priority basis under Rule 34 of the Trade Marks Rules, 2017. The rule says an expedited application is examined ordinarily within three months of submission.

The request costs ₹20,000 per class for individuals, startups and small enterprises, and ₹40,000 per class for everyone else.

What it is

A normal trademark application waits in the queue for examination. Rule 34 lets an applicant who has received the official application number ask for priority handling, so the examination report comes sooner. After the report, reply, hearing, publication and opposition steps are also dealt with expeditiously, subject to the Registrar’s published guidelines.

This is faster processing, not a shortcut. The Registrar still examines the mark against Sections 9 and 11 of the Trade Marks Act, 1999, the mark is still advertised in the Trade Marks Journal, and third parties can still oppose within four months. The Registrar may also cap the number of expedited applications through a notice in the Journal.
