What it is

The Seeds Act, 1966 makes sure seed on sale meets the labelled quality. Section 7 bars anyone from selling seed that is not identifiable by kind or variety, does not meet the minimum germination and purity limits, or is not marked and labelled as required. The Seeds (Control) Order, 1983 adds the licensing layer.

Clause 3 of the Order says no person may carry on the business of selling, exporting or importing seeds without a licence. The licence comes from the licensing authority the State Government appoints, normally in the agriculture department. Fees, forms and validity are set at the state level, so we confirm Haryana’s current process, or your state’s, before we file.

Seed shops and agri-input dealers

A shop in a Faridabad or Palwal mandi that sells seed packets to farmers needs its own licence, separate from any pesticide or fertiliser licence it holds.

Wholesalers and distributors

If you buy seed from companies and supply it to retailers, you are in the business of selling and need a licence for your premises.

Importers and exporters

What happens if you sell without a licence

Prosecution under the Essential Commodities Act

The Seeds Control Order is made under that Act, and breaches can be prosecuted. The court decides the penalty after trial.

Seizure of stock

Seed inspectors under the Seeds Act may take samples, enter and search premises, and seize seed that fails the standards, for up to 30 days.

Tougher penalties in Haryana

Section 19 of the Seeds Act sets small fines. In March 2025 the Haryana Assembly passed an amendment adding imprisonment and fines of ₹50,000 to ₹5 lakh, depending on the offender and repeat offences. We confirm its current status when you apply.

Do I need a licence to sell seeds in India?

Yes, clause 3 of the Seeds (Control) Order, 1983 says no one may carry on the business of selling, exporting or importing seeds without a licence. The state licensing authority issues it. A shop or distributor always needs one, and we check your case first.

Who issues the seed licence?

The licensing authority appointed by the State Government, usually within the agriculture department, issues it. In Haryana that is the Department of Agriculture and Farmers Welfare. Is a seed licence the same as a pesticide or fertiliser licence?

No, each product has its own law and licence. Seeds fall under the Seeds Act and the Control Order, pesticides under the Insecticides Act, 1968 and fertilisers under the Fertiliser (Control) Order, 1985. What are the penalties for selling bad seed?

Section 7 of the Seeds Act bars sale of seed that is mislabelled or below the germination and purity limits. Section 19 sets the central penalty: a fine up to ₹500 for a first offence, and imprisonment up to six months or a fine up to ₹1,000 or both for later ones. Haryana has passed a heavier amendment. Good records protect honest dealers.

What is the Haryana Seeds Amendment Bill 2025?

It is a state amendment that inserts Section 19A into the Seeds Act. It proposes imprisonment and fines for violating Section 7, ranging from ₹50,000 to ₹1 lakh for a dealer’s first offence up to ₹3 lakh to ₹5 lakh for a producer’s repeat offence. The Assembly passed it in March 2025. We confirm its current force before you rely on the numbers.

How long is a seed licence valid?

Validity and renewal terms are set by the state, so there is no single answer. Whatever your licence says, apply for renewal before it expires, because selling in a gap is selling without a licence. We note your exact date from the licence copy and diarise reminders for you, so nothing lapses.

Can I sell seeds online with a seed licence?
