What it is

A treatment, storage and disposal facility, or TSDF, is a dedicated site that stores, treats and finally disposes of hazardous waste, usually in a secured landfill or an incinerator. Many industrial clusters depend on common TSDFs, since a single factory seldom has the scale to build one.

The Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 govern it, and the State Pollution Control Board authorises the operator. TSDF services cover company set-up, clearance, consent and authorisation filings, and follow-up with the board.

Why it matters

Waste has to go somewhere lawful

Without an authorised facility nearby, generators cannot clear their waste on time, which can stall their own consents.

Obtain consent to establish and operate

We file the consent applications with the State Pollution Control Board. In Haryana, that is the HSPCB portal (see HSPCB consent to establish and operate).

Apply for authorisation in Form 1

Rule 6 requires Form 1 with the board, and our hazardous waste authorization page covers it in detail. We check the annexures against the board checklist before it goes in.

Timelines

120 days for authorisation

Rule 6 provides for the board to grant or refuse authorisation within 120 days of a complete Form 1 application.

Five-year validity

An authorisation is valid for five years. Plan the renewal about three months before expiry, with a self-certified compliance report.

30 June each year

The annual return in Form 4 is due by 30 June following the financial year.

What happens if you miss it

Penalty under the Environment Protection Act

Section 15 of the Environment Protection Act provides a penalty of ₹10,000 up to ₹15 lakh, plus up to ₹10,000 for each day the failure continues.

Directions to stop

Section 5 lets the authorities direct closure or stoppage of electricity and water to the facility.

Liability for the waste

Rule 23 of the 2016 Rules places liability on the occupier and the disposal operator. A generator using an unauthorised site stays exposed.

Who gives environmental clearance for a TSDF?

Item 7(d) of the Schedule to the EIA Notification, 2006 covers common hazardous waste treatment, storage and disposal facilities. In a project reviewed by a State Environment Impact Assessment Authority, terms of reference and a public hearing both applied, and the State Expert Appraisal Committee recommended clearance. Your state authority will confirm the route for your site.

How long does the hazardous waste authorisation take?

Rule 6 of the 2016 Rules provides for the State Pollution Control Board to grant or refuse authorisation within 120 days of a complete Form 1 application. An authorisation is valid for five years. A complete file is what keeps the clock short, so we check every annexure before the application goes in.

Why do generators need an authorised TSDF?

Rule 4 of the 2016 Rules lets an occupier send or sell hazardous waste only to an authorised actual user or disposal facility. A generator that sends waste to an unauthorised site stays liable. Choosing a TSDF with a valid authorisation is therefore part of your own compliance. We help you verify the paperwork.

How long can a TSDF store hazardous waste?

Rule 8 of the 2016 Rules allows storage of up to 90 days, and up to 180 days for certain categories, such as small generators, actual users and disposal operators. The authorisation can specify different limits for your site. We read your authorisation and set up the storage log against it.

What returns does a TSDF operator file?

An operator files Form 4, the annual return, by 30 June following the financial year, and keeps records in Form 3. Transport uses a manifest in Form 10 and an accident is reported in Form 11. We set up a calendar so no filing slips past its date.
