What it is

A trademark certified copy is a copy of an entry in the Register of Trade Marks, or of a document on the Registry file, that the Registrar certifies as true. It is different from the registration certificate you already hold and from a search report. It proves what the Registry records show on the day it is issued, nothing more.

Section 148(2) of the Trade Marks Act, 1999 lets any person apply to the Registrar, on payment of the prescribed fee, for a certified copy of any entry in the register or any document open to public inspection. Who it applies to

Brand owners going to court

Your advocate is drafting a plaint against a copycat in Delhi and asks for proof of registration. A certified copy of the register entry shows the mark, class, owner and status as the Registry holds it.

Exporters and foreign filers

Say a Faridabad exporter wants the same brand protected in the UAE. The foreign office may ask for a copy of the Indian application certified by the Registry. The Paris Convention gives six months for trademarks, so order the copy early.

Buyers, lenders and licensees

Before you buy a brand, take a licence or accept it as security, a certified record of ownership and status is firmer than a screenshot of the public search page.

Timelines

Foreign priority

A trademark priority claim must be made within six months of the first filing. Order the certified copy of the Indian application well before that date.

Renewal window

Registration lasts ten years under Section 25. Check status before you rely on an old copy, because a lapsed mark changes the record.

What happens if you do not have it in time

A foreign priority can be lost

Without the certified copy, a foreign office may not accept your priority claim, and the earlier Indian date stops helping you abroad.

Court proof may be questioned

A plain printout may be challenged by the other side. You may then lose time getting the certified record in the middle of the case.

A wrong request costs a fee

You can apply for a duplicate registration certificate in Form TM-M. The fee is ₹900 on e-filing and ₹1,000 on paper, the same fee entry as a certified copy. A duplicate replaces the lost certificate. If you need proof of the register entry, a certified copy is a separate request.

Can I use a trademark certified copy abroad?

Yes, for a priority claim you can use a copy of your Indian application certified by the Registry. Under the Paris Convention, the priority period for trademarks is six months from the first filing, and Article 4D(3) says the certified copy needs no further authentication.
