GSTR-10 Final Return: Filing After GST Cancellation
The GSTR-10 final return is the last GST return you file after your registration is cancelled or surrendered. It is due within three months of the cancellation date or the cancellation order, whichever is later. We prepare it, match it to your books and file it on the GST portal.
What it is
GSTR-10 is the closing statement of your GST life. It reports the stock you still held on the date of cancellation and the input tax credit linked to it. It also shows any tax you owe on that stock.
The law is Section 45 of the CGST Act, 2017 and Rule 81 of the CGST Rules. The return is filed on the GST portal under Services, Returns, Final Return. It is filed once. There is no revision window like the one a regular return gets.
Who it applies to
You cancelled voluntarily
Say a Faridabad manufacturer closed its unit, or a small trader dropped below the registration threshold. Either applied for cancellation in Form GST REG-16. Once the cancellation is approved, GSTR-10 is next.
The officer cancelled it
If the officer cancelled your GSTIN for non-filing and you are not seeking revocation, the final return is still due, counted from the date of the order if that is later.
You are not covered
Section 45 applies to registered persons who file regular returns under Section 39(1). Input Service Distributors, non-resident taxable persons and TDS or TCS deductors follow a different route.
Why it matters
It closes your tax account
Without GSTR-10, the portal shows an open obligation against a dead GSTIN. Notices keep coming to an address you may have already left.
It settles the stock liability
Section 29(5) makes you pay the credit on inputs, semi-finished goods, finished goods and capital goods still in stock when you stop. GSTR-10 is where that payment is declared.
It shuts the door on later assessment
An unfiled final return invites an assessment under Section 62 and recovery from you personally if you are a proprietor or partner.
Documents required
From your books
- Stock statement as on the cancellation date
- Purchase invoices for that stock with the credit taken
- Fixed asset register with purchase dates
From the GST portal
- Cancellation order or REG-16 acknowledgment
- Last filed GSTR-1 and GSTR-3B
- GST portal login with DSC or EVC access
Payment proof
- Challans for tax, interest and late fee already paid
- Bank details of the business
- Sale or write-off records for stock disposed of
How it works
Confirm the cancellation date
We read the order or REG-19 or REG-16 record and fix the exact date from which your three months run.
Clear every pending return
Here is the catch: the final return sits at the end of a chain. We file missing GSTR-1 and GSTR-3B up to the cancellation date so the numbers reconcile.
Count the stock and work out the credit
We prepare the stock list and compute the credit on inputs and capital goods held. The Section 29(5) amount is the higher of the credit on those items and the tax on their value, as the law prescribes.
File GSTR-10 on the portal
We pay what is due, file with your DSC or EVC and save the acknowledgment. We also check the portal shows the obligation closed.
Timelines
3 months
From the date of cancellation or the date of the cancellation order, whichever is later, under Section 45.
Counted from the order
If the officer cancelled backdated, the order date still gives you the later start date. We check which one applies.
Before any other plan
Do not wait for the GST annual return. GSTR-10 has its own clock and it does not move.
What happens if you miss the GSTR-10 deadline
Late fee under Section 47
₹100 per day under the CGST Act, capped at ₹5,000, with a matching State GST charge.
Interest on unpaid tax
Interest under Section 50 runs on any tax that should have been paid at closure.
Best-judgement assessment
Section 62 lets the officer assess a person who fails to file a final return, and Section 29(3) keeps your pre-cancellation dues alive.
GSTR-10 compared with other returns
People often confuse GSTR-10 with the annual return or the monthly returns. This table clears it up.
| Return | When it is filed | What it covers |
|---|---|---|
| GSTR-3B | Every month or quarter | Summary of sales, credit and tax paid |
| GSTR-9 | Once a year while registered | Annual summary of the financial year |
| GSTR-10 | Once, after cancellation | Closing stock, credit and final tax |
Closing a business also means closing the loop with the department, so read GST cancellation for the cancellation side, or GST return filing if monthly returns are still pending.
Frequently asked questions
What is the GSTR-10 final return?
GSTR-10 is the final return filed after your GST registration is cancelled or surrendered. It reports stock held on the cancellation date and the credit tied to it, and shows any tax payable. It is filed once under Section 45 of the CGST Act and Rule 81. We prepare it from your books and file it on the GST portal for you.
What is the due date for GSTR-10?
GSTR-10 is due within three months of the date of cancellation or the date of the cancellation order, whichever is later. The clock starts on that date, not when you notice the order. If the date is close, tell us at once so we can prioritise pending returns and finish the final return on time.
Who has to file GSTR-10?
Registered persons whose registration has been cancelled or surrendered and who were filing regular returns under Section 39(1) must file it. Input Service Distributors, non-resident taxable persons and TDS or TCS deductors are outside this route. If you are unsure which group you fall in, we check the rule against your registration type before filing anything.
What is the late fee for GSTR-10?
The late fee is ₹100 per day under the CGST Act, capped at ₹5,000, with a matching State GST amount under Section 47. Interest at 18 per cent a year may apply to unpaid tax under Section 50. Late fee is easier to cap when you file sooner, so do not leave it for the last week.
Do I have to file GSTR-10 if I had no sales or stock?
Yes. The final return is still required even when there is nothing to report. A nil closing stock statement is a valid return and it closes the obligation on the portal. We still check the books for stock, capital goods and pending returns first, since a nil return filed in error cannot be revised.
Do I need to file pending GSTR-1 and GSTR-3B first?
You should. Returns up to the cancellation date need to be filed so the final return reconciles with them. Filing the final return over a gap invites a notice. We clear the earlier months first, then file GSTR-10, so the stock and credit figures agree with what the portal already shows.
How is the tax on closing stock calculated?
Under Section 29(5), you pay an amount equal to the input tax credit on inputs held in stock, semi-finished or finished goods and capital goods, or the output tax on them, whichever is higher. For capital goods, the credit is reduced by the prescribed percentage points. We compute this item by item from your invoices.
Can I revise GSTR-10 after filing?
No. GSTR-10 cannot be revised once filed, so every figure must be right the first time. Mistakes can only be dealt with through the department, often with a notice. That is why we reconcile the stock and credit with your books before we submit.
Is GSTR-10 needed if I get my registration revoked?
If the officer restores your registration, the final return is not the route; you carry on filing regular returns. If revocation is rejected or you decide to close, GSTR-10 becomes due on the original clock. We help you decide early, because the final return clock keeps running while you wait.
What it costs
Our fee plus the government fee that applies to your case, quoted before you commit. Tell us the situation and we will price it exactly.
Government charges you may meet on this filing: there is no portal fee for GSTR-10. Late fee under Section 47 is ₹100 per day under the CGST Act (capped at ₹5,000, with a matching State GST amount). Interest on unpaid tax under Section 50 is 18 per cent a year.
