BOCW Registration and Construction Welfare Cess

If you run building or other construction work with 10 or more workers, the site must be registered as an establishment, and you pay a welfare cess of 1% of the cost of construction. Since 21 November 2025 these rules sit in the OSH Code and the Code on Social Security. We register the site, work out the cess and keep the records straight.

What it is

BOCW stands for building and other construction workers. For almost three decades, two 1996 laws covered them. The BOCW Act made employers register their sites. The BOCW Welfare Cess Act collected a cess on construction cost for the state welfare boards.

On 21 November 2025 the four labour codes came into force. Site registration, safety and working conditions moved into the Occupational Safety, Health and Working Conditions Code, 2020 (the OSH Code). The cess and the welfare boards moved into the Code on Social Security, 2020, Sections 100 to 108. Most people still call it “BOCW registration”.

“Building or other construction work” is wide. It covers buildings, roads, bridges, pipelines, towers, power lines, dams and tunnels, from new construction to repair and demolition.

Who it applies to

You build for sale or rent

Any employer carrying out building or other construction work with 10 or more workers on any day counts as an establishment under Section 2(1)(u) of the OSH Code.

You execute someone else’s project

Civil, electrical, road and tower contractors who employ the workers on site. Where you bring in workers through sub-contractors, the contract labour licence rules apply as well.

You build your own premises

Picture a Faridabad trading company putting up a warehouse on its own plot in Sector 24. It is an employer for this purpose. Construction related to a factory or mine is excluded, as it falls under those rules instead.

Workers get welfare benefits

The cess funds the state building workers’ welfare board, whose schemes reach the workers registered with it.

Clean approvals and payments

Government and public sector clients can deduct the cess at source from your bills. Correct paperwork keeps those deductions reconciled.

Safety duties are clear

Registration brings the site under the OSH Code’s safety rules. Sites with 250 or more workers must also appoint safety officers under Section 22.

How it works

Test whether the site is covered

We look at the type of work, the peak headcount and the two exclusions: factory-related work and own-residence work up to ₹50 lakh.

Register the site and send the start notice

We file the electronic application with the registering officer within 60 days, as Section 3 of the OSH Code requires, and send the notice of commencement under Section 5.

Pay the cess in advance

We work out 1% of the estimated cost, leaving out land. Here is the catch: the estimate needs a chartered engineer’s certificate, and the advance goes in before work starts, not at the end.

Keep registers and file returns

Section 33 requires registers of workers, wages, hours and attendance, and returns in the prescribed form. We set these up with your payroll compliance.

Close the cess on actual cost

Within 60 days of completion, we file the final self-assessment and settle any balance. In practice, a project that ran over budget owes cess on the extra spend too.

Timelines

Registration within 60 days

Apply electronically within 60 days of the OSH Code applying to the site. If the officer does not act in the prescribed time, the establishment is deemed registered.

Changes within 30 days

Report a change in ownership, management or other registered particulars within 30 days.

Final cess within 60 days of completion

The final self-assessment is due within 60 days of the project’s completion.

What happens if you miss it

Interest on late cess

Late cess carries interest at 1% per month or part of a month from the due date, so even a few days count as a full month.

Penalty up to the cess

Under Section 104 of the Code on Social Security, the penalty can go up to the amount of cess due, though it can be waived if you show good and sufficient reason at the hearing.

Late fee and inspection risk

Registration after 60 days carries a late fee. An unregistered site is the first thing an inspector notices.

Frequently asked questions

Is the BOCW Act still in force in 2026?

No, it was replaced when the labour codes came into force on 21 November 2025. Site registration and safety now sit in the OSH Code, 2020, and the welfare cess in Sections 100 to 108 of the Code on Social Security, 2020. Rules made under the old Acts continue during the transition until new rules replace them. So the duties look familiar; only the law behind them has changed.

How many workers trigger BOCW registration?

Ten. Under Section 2(1)(u) of the OSH Code, building or other construction work in which 10 or more workers are employed is an establishment that must register. The count is the headcount on any day, including workers engaged through contractors, not an average. If your site peaks at 12 workers for a week, it is covered. What is the BOCW cess rate and how is it calculated?

The cess is 1% of the cost of construction, notified by S.O. 2322(E) dated 8 May 2026. The Code allows a rate between 1% and 2%. Cost excludes the cost of land and any compensation paid to workers under Chapter VII of the Code. For a project costing ₹5 crore excluding land, the cess is ₹5 lakh. We check the cost base so you pay the right amount.

Do I pay cess on my own house?

Not if the work is for your own residence and the total cost does not exceed ₹50 lakh. The OSH Code excludes such work from “building or other construction work”, unless the government notifies a higher amount. A house built for sale or rent, or costing more than ₹50 lakh, is covered. Keep the estimate and plan on file, and the position is easy to show.

When is the cess paid?

An advance is paid before work starts, based on the estimated cost certified by a chartered engineer. Within 60 days of completion, you file a final self-assessment on the actual cost and pay any balance. On government and public sector contracts, the cess can be deducted at source from your bills instead. Either way, a proper reconciliation at the end closes the matter cleanly.

What is the interest and penalty for late cess?

Interest runs at 1% per month or part of a month from the due date, so a delay of a few days attracts a full month’s interest. Under Section 104 of the Code on Social Security, a penalty of up to the cess amount can be imposed. It can be waived if you show good and sufficient reason at the hearing. Paying the advance on time keeps both away.

My site was registered under the old BOCW Act. Do I re-register?

Generally, no. The OSH Code treats establishments registered under the earlier central labour laws as registered under the Code, subject to its conditions. You should still update any change in ownership or particulars within 30 days and follow your state’s transition notices. State rules under the Code may still be pending. We track these updates and tell you if any action is needed.

Can I appeal a cess assessment?

Yes. An appeal against a cess assessment can be filed within 90 days, and the appellate authority is expected to decide it within 60 days of receiving it. The appellate order is final. Records of actual cost, bills and the engineer’s certificate make the strongest appeal. A well-documented self-assessment usually avoids the dispute altogether.
