Patent Drafting: Provisional and Complete Specification in India

Patent drafting is the writing of the specification and claims that decide what your invention is protected for. A weak draft can narrow your rights or draw objections that take months to answer.

A complete specification must be filed within 12 months of a provisional one, so the draft needs to be ready well before that date.

What it is

The specification is the technical document at the heart of your patent application. It carries the title, a description, drawings, the claims and an abstract. The claims are the legal boundary: they say exactly what nobody else may make or use without your permission.

Section 10 of the Patents Act, 1970 sets the content. A complete specification must fully and particularly describe the invention and its operation or use, disclose the best method known to you, and end with claims. Under Section 10(5), claims must relate to a single invention or one inventive concept, be clear and succinct, and be fairly based on what you disclosed. A patent is worth only as much as its claims. Too narrow and a rival designs around them. Too broad and the examiner objects.

Timelines

Provisional to complete

Under Section 9(1), the complete specification must follow within 12 months of filing the provisional, or the application is deemed abandoned.

Publication

Applications are published 18 months after filing or priority under Section 11A. Anything in the draft becomes public then.

Request for examination

Rule 24B requires the request within 31 months from the priority or filing date, whichever is earlier, as amended in March 2024.

What happens if the draft is weak or late

Miss the 12-month window after a provisional and the application is treated as abandoned under Section 9.

Narrow or invalid claims

Claims that are unclear, unsupported by the description or covering more than one invention face objection and later challenge.

You cannot add new matter later

What is patent drafting?

Patent drafting is the preparation of the specification, claims, abstract and drawings for a patent application. Section 10 of the Patents Act, 1970 sets what a complete specification must contain: a full description, the best method, and claims. The claims define your legal protection. What is the difference between provisional and complete specification?

How many claims can I include?

There is no fixed maximum, but the standard Form 1 fee covers up to 10 claims. Each extra claim costs ₹320 for natural persons and startups, ₹800 for small entities and ₹1,600 for others, when filed online. We keep claims focused so protection is strong without extra fees.

How many pages does the fee cover?

The standard fee covers up to 30 sheets of specification. Each sheet beyond that costs ₹160 for natural persons and startups, ₹400 for small entities and ₹800 for others, when e-filed. A tight, clear draft usually stays within the limit. We review the length before filing.

Can software or a business method be patented?

Section 3(k) excludes a computer programme per se, a mathematical method and a business method from patent protection. A software-linked invention can still qualify if it shows a technical effect and the claims are framed accordingly. We review your idea honestly and tell you if another route, such as copyright, fits better.

Who signs the patent specification?

Do I need a patent search before drafting?

When does my patent application become public?

Under Section 11A, an application is published 18 months from the filing or priority date. After that, anyone can read the specification. Before publication, keep the invention confidential.
