What it is

Plastic recycling plant setup here means the approvals path for a unit that turns plastic waste into flakes, granules or other recycled material. The shredders, washing lines and extruders are for your machinery supplier. We handle the licences and the portal work that make the plant legal and let its output earn EPR certificates.

The governing law is the Plastic Waste Management Rules, 2016, as amended, with the Guidelines on Extended Producer Responsibility for plastic packaging notified by the Ministry of Environment, Forest and Climate Change in February 2022. Registration is on the centralised EPR portal run by the Central Pollution Control Board (eprplastic.cpcb.gov.in), while the State Pollution Control Board grants consent under the Water and Air Acts and verifies the plant.

Register to sell certificates

Producers, importers and brand owners (PIBOs) meet their EPR targets by buying certificates. Only a registered, verified Plastic Waste Processor can generate them on the portal.

Ride demand written into law

Recycling targets for PIBOs rise from 30–50% in 2024-25 to 60–80% from 2027-28, by category. The 2026 amendment also sets recycled-content targets, for rigid packaging rising from 30% in 2025-26 to 60% from 2028-29.

PWP registration needs valid consents, so the order matters. Here is the catch: a consent taken for 2 tonnes a day does not cover a line later expanded to 5. In practice, we size the CTE application to the capacity you plan to reach, not just the first machine.

Fix the entity and the site

We check that the site’s land use permits industry, then form the entity and register PAN, GST and Udyam, which many recyclers qualify for as micro or small enterprises.

Apply for consent to establish

Before civil work, we file the CTE with your process, water use and pollution controls. In Haryana we handle HSPCB consent to establish and operate on the OCMMS portal.

Timelines

Expect four months for consent

Under Section 25(7) of the Water Act, consent is deemed granted if a complete application is not decided within four months. Under the consent guidelines amended in January 2026, a CTO stays valid until cancelled.

Give factory notice 15 days ahead

Factory plan permission is deemed granted if no order comes within three months (Factories Act, Section 6(2), still applied during the move to the OSH Code), and notice of occupation goes in at least 15 days before you start.

File the EPR return by 30 June

Registered PWPs file an annual return on the CPCB portal by 30 June for the previous financial year.

What happens if you skip an approval

Closure and power cut

Section 31A of the Air Act and Section 33A of the Water Act allow closure and stopping of electricity and water. Section 37 of the Air Act carries a penalty of ₹10,000 to ₹15 lakh.

Environment Act penalty

Breaking rules made under the Environment (Protection) Act, 1986 attracts a penalty of ₹10,000 to ₹15 lakh under Section 15, plus up to ₹10,000 a day while it continues.

No certificates, no EPR income

An unregistered plant can recycle, but brands cannot count its output towards their targets. That cuts you out of the certificate market.

What licences do I need to start a plastic recycling plant?

You need pollution consents, factory approvals and PWP registration on top of your basic business registrations. That means PAN, GST and Udyam for the entity; a Consent to Establish and then a Consent to Operate from the State Pollution Control Board; factory plan approval and a factory licence; a fire safety certificate where the building needs one; and registration as a Plastic Waste Processor on CPCB’s EPR portal. What is PWP registration?

It is registration as a Plastic Waste Processor on CPCB’s centralised EPR portal for plastic packaging. Recyclers, waste-to-energy and waste-to-oil plants, cement kilns co-processing plastic and industrial composters all register this way. After you register online, the State Pollution Control Board physically verifies the unit and confirms your conversion factor. Only then can you generate certificates. Complete documents and valid consents keep verification smooth.

Can I register on the EPR portal without SPCB consent?

No. Valid consents from your State Pollution Control Board, both CTE and CTO, are part of the PWP document set, and the regional officer checks them during verification. The consent must also cover the plastic processing you actually do. If your consent was taken for a different product or a smaller capacity, it needs amending first. We check your consent orders against your planned registration before uploading anything, so the file is not returned.

Which certificates can a recycler generate?

A recycler generates recycling certificates for Category I (rigid), Category II (flexible) and Category III (multi-layered) plastic packaging. Category IV compostable plastic goes to industrial composting plants, and end-of-life routes such as waste-to-energy and co-processing issue end-of-life certificates. Certificates are generated on processed quantities using the conversion factor confirmed at verification. Keeping clean input and output records means your certificates stand up when a buyer or the Board checks.

How do recycled-content rules help a recycler?

They create steady demand for recycled plastic. The Plastic Waste Management (Amendment) Rules, 2026, G.S.R. 237(E) dated 31 March 2026, set recycled-content targets for brand owners: for Category I rigid packaging, 30% in 2025-26 rising to 60% from 2028-29, with lower targets for flexible and multi-layer packaging. Relaxations apply where FSSAI or other regulators restrict recycled plastic in contact with food or drugs. For a registered recycler, that means more buyers looking for your output.

Do recycled plastic products need BIS certification?

It depends on the product you make, not on recycling as such. The 2026 amendment refers to IS 14534:2023 for labelling of recycled plastic, and some end products have their own standards. If you sell into food-contact packaging, FSSAI’s rules on recycled plastic apply as well. We check whether your specific output falls under any mandatory certification before you launch it, and if it does, we coordinate with the certifying body.

How long does it take to set up the approvals?

Plan for some months, run alongside construction. Consent is deemed granted if the Board does not decide a complete application within four months under Section 25(7) of the Water Act, and factory plan permission is deemed granted after three months under Section 6(2) of the Factories Act. PWP registration follows the CTO. Most delays come from consent orders that do not match the planned capacity. Getting that right at the CTE stage keeps the rest on track.
