FSSAI Licence Modification

What it is
An FSSAI licence modification is an online application to change the details on your existing food licence or registration. The licence number stays the same. Only the details change, and the authority issues an amended licence.
The rule is regulation 2.1.9 of the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. A food business must tell the licensing authority about any change in product category, layout, expansion, closure or other material information before making it. Where the change alters what is printed on the licence, you need approval before you start business with that change. Applications are filed on FoSCoS, FSSAI’s online licensing system.
Who it applies to
State and central licence holders
Any business holding an FSSAI state licence or a central licence that wants to change licence details applies through FoSCoS.
Registered petty food businesses
Holders of basic FSSAI registration also modify their certificate online when details change, at a smaller fee.
Businesses adding products or capacity
A manufacturer adding a new food category or raising production capacity needs the change endorsed on the licence first. Think of a Faridabad bakery licensed for bread and biscuits that now wants to make namkeen: the new category goes on the licence before the first batch.
Companies that changed name or office
A company that changed its name or registered office with the ROC must carry that change to FSSAI too. In practice, it is easy to forget once the ROC work is done.
Businesses changing staff or contacts
Changes in contact details or supporting documents are made through a simpler non-Form C modification.
Legal heirs after a death
Under regulation 2.1.11, the licence continues for the legal representative or family member for 90 days from the date of death, and they apply for transfer.
Why it matters
Keep every product inside the licence
Section 31 of the Food Safety and Standards Act, 2006 allows food business only under a licence. Making a product category your licence does not cover is a compliance gap.
Pass inspections without a mismatch
Food safety officers compare what you make and where with what the licence shows. A mismatch invites an improvement notice under section 32.
Satisfy buyers and platforms
Distributors, retail chains and online platforms match the licence name, address and products with your invoices and labels.
Form C and non-Form C changes
FoSCoS splits modifications into two types. Pick the wrong one and the fields you need stay locked, so this choice comes first.

We log in with your FoSCoS credentials, select the modification categories and edit the Form B application.
Upload documents and pay the fee
All documents go up again, along with the purpose of the change. The fee is paid online on FoSCoS.
Handle queries and any inspection
The authority may raise queries or order an inspection before approving. We reply within the time allowed.
Download the amended licence
Once approved, the amended licence is available on FoSCoS under the same licence number.
Timelines
File before the change goes live
Regulation 2.1.9 asks you to inform the authority before implementing the change, and to get approval before starting business with it.
Expect approval within 30 days
The licensing authority may approve and issue the amended licence within 30 days from receiving the information.
Reply to queries within 30 days
If the authority asks for clarification, the reply is due within 30 days of the query.
What happens if you skip the modification
An improvement notice arrives
Under section 32 of the FSS Act, the designated officer can serve an improvement notice giving at least 14 days to comply, followed by suspension and cancellation.
The activity counts as unlicensed
Business carried on outside the licence can be treated as business without a licence. Section 63 provides up to six months’ imprisonment and a fine up to ₹5 lakh.
Errors repeat in every return
Old details carry into your FSSAI annual return and yearly fee payments, so one mismatch repeats every year.

Which changes need an FSSAI licence modification?
Any change to details printed on the licence needs a modification before you act on it. Regulation 2.1.9 covers changes in product category, layout, expansion, closure and other material information. On FoSCoS these are Form C changes: name, address details, kind of business, category and products. Smaller changes like contact details go through a non-Form C modification.
What is the government fee for FSSAI modification?
FoSCoS’s own user guide lists ₹1,000 for modifying a licence and ₹100 for modifying a registration. Where the change raises capacity into a higher fee slab, the difference in the annual licence fee is also payable. Regulation 2.1.9 of the 2011 regulations speaks of a fee equal to one year’s licence fee, so we confirm the amount FoSCoS shows for your case before you pay.
Does the licence number change after modification?
No, the licence number stays the same after a modification. The authority issues an amended licence carrying the new details under the existing number. This matters because the number is printed on your labels and packaging. If you are moving from registration to a licence, or from a state to a central licence, that is a different process, and we tell you which one applies.
How long does FSSAI take to approve a modification?
Regulation 2.1.9 lets the licensing authority approve and issue the amended licence within 30 days of receiving the information. The authority may order an inspection first if it thinks one is needed. If it raises a query, you have 30 days to reply. Re-uploading every document correctly keeps the file moving.
Can production of a new product start before approval?
No, not if the new product changes what your licence shows. Regulation 2.1.9 requires approval or endorsement on the licence before you start business with such a change. Production or sale of an unlisted category is open to action under the FSS Act. Plan the modification a month ahead of launch, and your new product reaches the market without a compliance gap.
What if turnover crosses into a higher licence band?
Then you need a different licence, not just a modification. Here is the catch: a growing Faridabad spice packer can outgrow its state licence in a good year without changing a single product. From 1 April 2026, registration covers turnover up to ₹1.5 crore, a state licence above ₹1.5 crore up to ₹50 crore, and a central licence above ₹50 crore. Do contact or staff changes cost anything?
Contact details and supporting documents are changed through a non-Form C modification on FoSCoS. Only fields that are not printed on the licence open for editing, so no new licence is printed. Keep the mobile number and email current, because FoSCoS sends its alerts there. We confirm on the portal whether any fee applies before filing.
What happens to the licence if the proprietor dies?
Regulation 2.1.11 keeps the licence running for the legal representative or a family member for 90 days from the date of death, or longer if the designated officer approves in writing. Within that time they apply for transfer of the licence. The authority may approve the transfer after an inquiry and a hearing. We prepare the papers so the business keeps running.
Is a lost licence certificate a modification?
No, a lost, destroyed or damaged licence is replaced through a request for a duplicate. Schedule 3 to the licensing regulations sets that fee at 10% of the applicable licence fee.
