Trademark Class 9: Electronics, Software and Scientific Apparatus
Class 9 covers computers, phones and accessories, downloadable software, chargers, CCTV, safety gear and scientific instruments. Search carefully and word your goods tightly before you file.
What class 9 covers
The official Class 9 heading covers scientific, measuring, signalling, safety and teaching apparatus; apparatus for controlling electricity; apparatus for recording, transmitting or processing sound, images or data; downloadable media and software; computers, peripherals and calculators; diving gear; and fire extinguishers.
The explanatory note says the class mainly covers apparatus for scientific, audiovisual and IT use, plus safety and life-saving equipment. The current edition is NCL 13-2026, in force from 1 January 2026, and the Trade Marks Registry follows it.

What is not in class 9
The WIPO notes place these in other classes, and a wrong class can draw an objection.

Here is the catch: older guides still list eyewear in Class 9. The current edition puts spectacles, contact lenses and sunglasses in Class 10.

Run a trademark search in Class 9 and every class you plan to add. Check sound-alike and spelling variants, not just the exact word.
Name your goods precisely
Name the goods, such as “mobile phone cases” or “downloadable accounting software”. A precise list draws fewer queries.
Split product from service
In practice, a downloaded app is Class 9, while software users log in to on your servers is Class 42. Many businesses need both.
Pick the right applicant name

Frequently asked questions
Is a mobile app trademark filed in Class 9 or Class 42?
A downloadable app falls in Class 9, which covers downloadable computer software. Software you host online, known as software as a service (SaaS), falls in Class 42. Many app businesses file in both, so the brand is covered either way. We check how your product reaches users, so you pay only for the classes you need.
Are spectacles and sunglasses still in Class 9?
No. Under the current Nice edition, spectacles, contact lenses and sunglasses sit in Class 10, and the Class 9 note lists them as excluded. Older articles still show them in Class 9, so check before filing. Smartglasses, however, stay in Class 9. We match your exact products to the latest WIPO list before drafting the application.
Do phone covers and chargers belong in Class 9?
Yes. Cases for smartphones are named in the Class 9 explanatory note, and chargers and batteries are apparatus for accumulating electricity. Most accessory brands need only Class 9. Can I file Class 9 together with another class?
Yes. One brand can be filed in several classes, but the government fee is charged for each class and each mark. Class 9 plus Class 42 means two fees, ₹4,500 or ₹9,000 each depending on the applicant.
