Trademark Forms: TM-A, TM-M, TM-O and Others Explained
Trademark forms are the standard applications you file with the Trade Marks Registry under the Trade Marks Rules, 2017. TM-A is for registering a mark, TM-M for miscellaneous requests, TM-O for oppositions and cancellations, and TM-R for renewal. Each form has one job, so picking the right one avoids delays.
Why the right form matters
The 2017 Rules cut the earlier long list of forms down to a handful. That is easier, but a request filed on the wrong form can be rejected or sit unanswered while a deadline runs. If you are starting from scratch, our trademark registration team picks and files the right one for you.
The main forms and what they do
- TM-A: application to register a mark for goods or services, including collective and certification marks.
- TM-M: miscellaneous matters such as corrections, amendments, extension of time, certified copies and divisional applications.
- TM-O: opposition matters, including the notice of opposition, the counter-statement, and applications to rectify or cancel a registered mark.
- TM-R: renewal of a registered mark.
- TM-C: requests for a search certificate, including expedited search.
- TM-P: proprietor-related matters like assignment approval and change of address.
- TM-U: recording a registered user.
- TM-G: registration of a trademark agent.
Replies to examination reports or formality objections go as a reply to the Registry, not on a numbered form.
Key points before you file
Match the form to the task, then check the fee for that form on the official IP India portal, since fees differ by filing mode and applicant type. A shop owner who wants to fix a spelling error in an application, for example, files TM-M, not a fresh TM-A. For a mark that is already registered, trademark renewals go on TM-R, and a change of owner is handled through trademark assignment filings. If someone challenges your mark, see trademark oppositions.
Common mistakes
- Using TM-A when the real need is a correction (TM-M).
- Missing the time limit for a counter-statement because the notice was never tracked.
- Entering the wrong class or applicant name, which later needs a correction.
- Filing on an old form number out of habit.
