What class 37 covers

The official class heading reads: “Construction services; installation and repair services; mining extraction, oil and gas drilling.” The explanatory note says the class mainly covers construction, plus services that restore objects to their original condition or preserve them without changing their properties.

Named examples include construction and demolition of buildings, roads, bridges, dams and transmission lines; painting, plastering, plumbing, heating installation and roofing; shipbuilding; rental of construction equipment; repair of electrical items, computer hardware, furniture and tools; restoration of buildings and artwork; and cleaning, laundering and pressing. India follows the current Nice edition, NCL 13-2026, in force since 1 January 2026.

Add a goods class if you make products

Class 37 protects the service. A contractor that also sells its own paints, fittings or modular furniture needs the goods class for those items.

Separate building from selling

If you build and also sell property, add Class 36. Plans and architecture go to Class 42.

Service businesses often grow city by city with similar names. Search the IP India register first by word and by sound.

Register before you franchise

A franchise agreement licenses a brand you should already own on paper. Start filing the trademark application before signing franchisees. Own it, then license it.

Frequently asked questions

Is car servicing in trademark class 37?

Yes. Vehicle maintenance and repair are class 37 services; the class 39 explanatory note confirms this by sending vehicle repair out of transport and into class 37. Car washing is also listed under class 37 cleaning services. Spare parts you sell under your own label are goods, usually Class 12. A workshop chain usually files class 37 first and adds classes as it grows.

Can one application cover class 37 and class 36 together?

Yes. Section 18(2) of the Trade Marks Act, 1999 allows a single application for several classes, but the government fee is charged for each class. So a brand filed in class 37 and class 36 pays two class fees on one Form TM-A. We will tell you which classes are worth the fee before we file.

Is tailoring in class 37 or class 40?

Custom tailoring is in Class 40, because it changes the material into a new item. Class 37 covers cleaning, laundering and pressing clothes, along with repair that restores an item. So a laundry and dry-cleaning chain files in class 37, while a made-to-measure tailoring business files in Class 40. If you do both, one application can list both classes.

How long does a class 37 registration last?

A registered trademark lasts ten years and can be renewed every ten years after that without limit. Under Section 23(1) of the Trade Marks Act, 1999 the registration counts from the date of application, and Section 25(1) sets the ten-year term. You can renew on Form TM-R up to one year before expiry, and even a missed renewal can be saved within the grace period, so the brand stays yours as long as you keep it alive.

What is the government fee for a class 37 trademark?

The government fee on Form TM-A is ₹4,500 per class for individuals, startups and small enterprises filing online, and ₹9,000 per class for others. Paper filing costs ₹5,000 and ₹10,000 respectively, so online filing is the cheaper route. Each extra class you add is charged at the same rate.
