What class 30 covers

The Nice Classification heading for Class 30 reads: “Coffee, tea, cocoa and substitutes therefor; rice, pasta and noodles; tapioca and sago; flour and preparations made from cereals; bread, pastries and confectionery; chocolate; ice cream, sorbets and other edible ices; sugar, honey, treacle; yeast, baking-powder; salt, seasonings, spices, preserved herbs; vinegar, sauces and other condiments; ice (frozen water).”

WIPO’s explanatory note says the class covers mainly foods of plant origin, other than fruits and vegetables, prepared or preserved for eating, and aids for improving the flavour of food. It also includes drinks based on coffee, cocoa, chocolate or tea, cereals such as oat flakes and muesli, and pizza, pies and sandwiches.

India applies the current Nice edition, NCL (13-2026), in force from 1 January 2026.

Tips before filing

1

Search Class 30 and its neighbours

Run a proper search of the IP India register in Class 30 and also Class 29. In practice, food marks in these two classes often overlap.

2

List the exact products

Write “spices, masalas, tea, atta” rather than “grocery items”.

3

Keep supplements and health drinks separate

Dietary supplements and medicinal teas belong in Class 5. Only ordinary foods go in Class 30.

4

Protect the outlet as well

A bakery café or sweet shop serving customers on site is a Class 43 service; filing it protects the shop name.

Frequently asked questions

Is a masala brand filed in trademark class 30?

Yes, spices, seasonings and salt are all in the Class 30 heading. Blended masalas, chaat masala and garam masala fit here. If you also sell edible oil or ghee, that is Class 29. Many food brands file both in one application, paying per class. We help you pick only the classes you need.

My sweet shop sells and serves food. Which class?

The sweets you sell are Class 30 goods, while serving food on site is a Class 43 service. WIPO’s note for Class 43 covers services for providing food and drink. A sweet shop that only sells packed boxes may need just Class 30; one with a seating area should consider Class 43 too. We file both in one application if you need them.

Is honey in class 30 or class 29?

Honey is in Class 30. The class heading lists sugar, honey and treacle together. Jams and jellies, by contrast, are Class 29 goods. So a brand selling honey and fruit jam would need both classes. Sugar and treacle sit beside honey in Class 30. We check each product before filing so nothing is misplaced.

Are cold coffee and iced tea in class 30?

Yes, drinks based on coffee, cocoa, chocolate or tea belong in Class 30, according to WIPO’s note. If milk predominates, the drink moves to Class 29, and fruit juices or soft drinks go to Class 32. Recipe and label wording decide this, so we review your product before filing and place each drink in the correct class.

What is the government fee for class 30?

The Form TM-A fee is ₹4,500 per class for individuals, startups and small enterprises e-filing, and ₹9,000 per class for others. Paper filing costs ₹5,000 or ₹10,000. A small spice brand filing in Class 30 alone pays ₹4,500 online. We confirm your category before filing so you pay the correct amount.

The Form TM-A fee is charged per class, and individuals, startups and small enterprises pay half, so Udyam registration or DPIIT startup recognition can halve it. A spice brand in Class 30 alone pays one class fee; a bakery café adding Class 43 pays two.
