Trademark class 32 protects brands on beer and non-alcoholic drinks: soft drinks, packaged drinking water, mineral and soda water, fruit juices, energy drinks and syrups. Water bottlers, juice brands and craft breweries file here.
What class 32 covers
The Nice Classification heading for Class 32 reads: “Beers; non-alcoholic beverages; mineral and aerated waters; fruit beverages and fruit juices; syrups and other preparations for making non-alcoholic beverages.”
WIPO’s explanatory note says the class covers mainly non-alcoholic beverages and beers. It also includes de-alcoholised drinks, soft drinks, rice-based and soya-based beverages other than milk substitutes, energy drinks, isotonic and protein-enriched sports drinks, and non-alcoholic essences for making drinks.
India applies the current Nice edition, NCL (13-2026), in force from 1 January 2026. Beer is the odd one out: it is alcoholic, yet it sits here and not with wines and spirits in Class 33.

Water bottlers
Plants packing drinking water, mineral water and soda in bottles and jars. A Faridabad plant supplying 20-litre jars to offices is a typical filer.
Juice and soft-drink brands
Makers of fruit drinks, squashes, energy drinks and regional soft drinks.
Breweries
Craft breweries and beer brands, which file in Class 32 and often add Class 43 for a taproom or brewpub.
Tips before filing
Search drinks across Classes 32 and 33
Run a proper search of the IP India register in Class 32. A beer brand should also look at Class 33, because drinks marks across these classes can clash.
Name the drinks you make
Write “packaged drinking water, soda water” or “fruit juices” rather than “beverages” alone.
Check the base of each drink
Milk-based drinks go to Class 29 and tea- or coffee-based ones to Class 30. Put each recipe in the right class.
Protect your brewpub or café
Serving drinks on site is a Class 43 service, so file it if the outlet carries your brand.
Frequently asked questions
Is packaged drinking water filed in trademark class 32?
Yes, mineral and aerated waters are in the Class 32 heading, and packaged drinking water falls here too. An FSSAI licence is a separate requirement and does not replace a trademark. We search your proposed name in Class 32 and file it so your label is protected as your plant scales up.
Why is beer in class 32 and not class 33?
Because the Nice Classification places beers in Class 32 by name, and Class 33 covers alcoholic beverages “except beers”. So a craft brewery files its beer brand in Class 32. De-alcoholised beverages are in Class 32 as well, as WIPO’s note confirms. A later wine or spirits launch would add Class 33, and we plan for that with you.
Is a milk shake or lassi drink in class 32?
No, milk shakes and drinks where milk predominates are Class 29 goods. Milk substitutes such as soya or almond milk also go to Class 29. Fruit juices, soft drinks and energy drinks stay in Class 32. We check your recipe and labels before filing and place each drink in the correct class, so the application is not delayed by a classification query.
Are energy drinks and sports drinks in class 32?
Yes, WIPO’s note lists energy drinks, isotonic beverages and protein-enriched sports drinks as Class 32 goods. Dietetic beverages for medical purposes are different and go to Class 5. If your drink is sold as a supplement, the label may point to Class 5. We review your product and suggest the right class, or both, before you pay any fee.
What is the government fee for class 32?
The Form TM-A fee is ₹4,500 per class for individuals, startups and small enterprises e-filing, and ₹9,000 per class for others. Paper filing costs ₹5,000 or ₹10,000. A small water-bottling firm filing in Class 32 alone pays ₹4,500 online. We confirm your category before filing so you pay the correct amount.
