Trademark class 31 protects brands on raw and unprocessed farm products, seeds for planting, live plants, live animals, animal feed, pet food and malt. Seed companies, cattle-feed makers and fresh-produce brands file here.
What class 31 covers
The Nice Classification heading for Class 31 reads: “Raw and unprocessed agricultural, aquacultural, horticultural and forestry products; raw and unprocessed grains and seeds; fresh fruits and vegetables, fresh herbs; natural plants and flowers; bulbs, seedlings and seeds for planting; live animals; foodstuffs and beverages for animals; malt.”
WIPO’s explanatory note says the class covers mainly land and sea products not prepared for eating, live animals and plants, and foodstuffs for animals. Here is the catch: washing or waxing fresh produce does not move it out of Class 31.
India follows the current Nice edition, NCL (13-2026), in force from 1 January 2026.

What is NOT in class 31
Processing or medical use moves an item out of Class 31. The Nice notes send these elsewhere:

A grain brand therefore often needs Class 31 for raw grain and Class 30 for packed flour or rice.

Seed and nursery businesses
Seed companies and plant nurseries supplying farmers and home gardeners.
Feed and pet-food makers
Cattle-feed, poultry-feed and fish-feed manufacturers, and pet-food and pet-litter brands.
Fresh-produce brands
Farmer producer organisations, fruit and vegetable packers and exporters who sell under a label, such as a Haryana FPO packing fresh vegetables under one name.
Tips before filing
Search Class 31 and Class 30 together
Run a proper search of the IP India register in Class 31. If you also sell packed flour or rice, search Class 30 as well.
Name your actual product lines
Write “cattle feed, poultry feed” or “seeds for planting” rather than “agricultural products”.
Keep medicated feed out
Feed supplements and medicated feed are Class 5 goods. File them there if you sell them.
Check seed variety rules separately
A trademark protects your brand name only. It does not register a plant variety, which is a separate process.
Frequently asked questions
Is cattle feed registered in trademark class 31?
Yes, foodstuffs and beverages for animals are in the Class 31 heading, so cattle feed, poultry feed and pet food all belong here. Medicated feed and dietary supplements for animals are the exception; they go to Class 5. If your range includes mineral mixtures or health supplements for livestock, we check each product and file in both classes where needed.
Do seeds go in class 31 or class 30?
Seeds for planting and raw, unprocessed seeds are Class 31 goods. Seeds processed for use as seasonings fall in Class 30, and seeds prepared for eating as snacks go to Class 29. So a seed company selling to farmers files in Class 31. We confirm the right class before we file.
Is rice in class 31 or class 30?
It depends on processing. Unprocessed rice is in Class 31, while rice as a prepared food is in the Class 30 heading. Most packed rice brands sold in shops therefore file in Class 30, while traders of raw paddy may need Class 31. We look at what you actually sell and file in the class that fits, or both if your business covers both.
Is pet food in class 31?
Yes, pet food sits in Class 31 as a foodstuff for animals. Pet litter, such as aromatic sand and sanded paper for pets, is also here, as WIPO’s note confirms. Medicated feed goes to Class 5, and clothing for pets goes to Class 18. We map your full range across classes before filing.
What is the government fee for class 31?
The Form TM-A fee is ₹4,500 per class for individuals, startups and small enterprises e-filing, and ₹9,000 per class for others. Paper filing costs ₹5,000 or ₹10,000. A farmer producer company that qualifies as a small enterprise pays ₹4,500 online for Class 31. If it also sells packed atta, Class 30 adds one more fee. We confirm the category before filing.
