Trademark Class 44: Medical, Beauty, Veterinary and Agricultural Services
Class 44 covers medical and dental care, diagnostics, beauty salons and spas, veterinary care, and agriculture, horticulture and gardening services. Hospitals, clinics, labs and salons file their service brands here. Registration lasts ten years and can be renewed.
What class 44 covers
The official class heading reads: “Medical services; veterinary services; hygienic and beauty care for human beings or animals; agriculture, aquaculture, horticulture and forestry services.”
The WIPO explanatory note says Class 44 covers medical care, including alternative medicine, hygienic and beauty care for humans and animals, and services in agriculture, aquaculture, horticulture and forestry. Telemedicine, health spas, tattooing and landscape design are all named in it.
Section 7(1) of the Trade Marks Act, 1999 asks the Registrar to follow the Nice Classification: 45 classes, with 1 to 34 for goods and 35 to 45 for services. The edition in force since 1 January 2026 is NCL 13-2026. Under Section 7(2), the Registrar’s decision on the class is final.

Search the medical and product classes
Run a trademark search in Class 44 and, if you sell your own products, in Class 3 or Class 5 too.
Avoid purely descriptive names
Here is the catch: names like “Best Dental Clinic” describe the service and face objections under Section 9 of the Trade Marks Act. Add a distinctive word you can own.
Register the chain name early
If you plan more branches or franchise outlets, register before opening the second one.
Add Class 9 or 42 for apps
Patients book or consult through your own app? The software may need Class 9 or Class 42 as well.
Frequently asked questions
Does a diagnostic lab file in Class 44?
Yes. Medical analysis for diagnostic and treatment purposes is listed in Class 44, so pathology and imaging labs file here. Scientific research for medical purposes, such as clinical research or drug trials, sits in Class 42 instead. In practice, a lab doing routine tests and research projects needs both. We read your service menu before suggesting the classes.
Is a gym in Class 44 because it is about health?
No. Health clubs for physical exercise are excluded from Class 44 and placed in Class 41. Class 44 covers health spas, massage, beauty treatments and medical care. A wellness centre offering workouts and spa treatments under one name can file in Class 41 and Class 44 together, with the official fee charged separately for each class.
Is pest control in Class 44 or Class 37?
It depends on where the pests are. Weed killing and pest control for agriculture, aquaculture, horticulture and forestry are in Class 44. Pest control in homes, offices and factories, such as termite treatment, is in Class 37. A Faridabad firm that sprays crops near Ballabgarh and also treats termites in housing societies should file both, so the brand is covered across its work.
Should a pharmacy or medicine brand file in Class 44?
Only for the advice part. Pharmacy advice and preparing prescriptions by pharmacists are Class 44 services. Medicines as products are goods in Class 5, and running a retail chemist shop is generally treated as a Class 35 retail service. A pharmacy chain with its own medicine brand often files in Class 5, Class 35 and Class 44.
How much does it cost to file a trademark in Class 44?
The government fee for Form TM-A is ₹4,500 per class when an individual, startup or small enterprise files online, and ₹9,000 per class for everyone else. Paper filing costs ₹5,000 or ₹10,000.
