Trademark Class 45: Legal, Security and Personal Services
Class 45 covers legal services, security and detective services, and personal and social services such as dating platforms, wedding ceremony planning, babysitting and funeral services. Law firms, security agencies and matchmaking businesses file here. Registration lasts ten years and can be renewed.
What class 45 covers
The official class heading reads: “Legal services; security services for the physical protection of tangible property and individuals; dating services, online social networking services; funerary services; babysitting.”
The WIPO explanatory note says Class 45 mainly covers legal and security services, plus certain personal and social services that meet individual needs. It names arbitration, domain name registration, compliance auditing, detective work, wedding ceremonies and even clothing rental.
Section 7(1) of the Trade Marks Act, 1999 asks the Registrar to follow the Nice Classification: 45 classes, with 1 to 34 for goods and 35 to 45 for services. The edition in force since 1 January 2026 is NCL 13-2026. Under Section 7(2), the Registrar’s decision on the class is final.

Tips before filing
Search Class 45 and your other classes
Run a trademark search in Class 45 and in Class 35 if you also do accounting or consulting.
Split legal from business services
Legal services go in Class 45, but accounting, tax filing and business consulting go in Class 35.
Avoid descriptive firm names
“Legal Associates” or “Security Services” describes the work and draws objections under Section 9. Lead with a distinctive word or name.
Keep the app and the service apart
A dating or social networking platform files the service in Class 45. The app itself may need Class 9 or Class 42.
Frequently asked questions
Does a CA or compliance firm file in Class 45?
Only for the legal part. Accounting, bookkeeping and tax return preparation are Class 35 services. Legal services and legal and regulatory compliance auditing are listed in Class 45. In practice, a Faridabad firm that files GST returns and also runs legal compliance audits files Class 35 and Class 45 in one application.
Does a private security agency need Class 45?
Yes. Guard services and security for the physical protection of property and people are Class 45 services. Guarded transport of cash or valuables is Class 39, so an agency guarding factories that later adds cash vans needs that class too. Trademark registration protects the agency’s name, but it is separate from the PSARA licence the agency needs to operate. We can help with both.
Is a matrimonial or dating website in Class 45?
Yes, the matchmaking service is in Class 45, which lists dating services and online social networking services. The website or app as software may need Class 9 for a downloadable app or Class 42 for software provided online. Most platforms file Class 45 first, then add the software class once the product is stable.
Is cyber security in Class 45 because it is a security service?
No. Class 45 covers security for the physical protection of property and people. Computer and internet security consultancy and data encryption are listed in Class 42. A company offering both guards and cyber security services needs both classes. Picking the right one at the start avoids an objection and a fresh application later.
How much does it cost to file a trademark in Class 45?
The government fee for Form TM-A is ₹4,500 per class when an individual, startup or small enterprise files online, and ₹9,000 per class for everyone else. Paper filing costs ₹5,000 or ₹10,000.
