Multi-State Co-operative Societies Act: Overview
The Multi-State Co-operative Societies Act, 2002 is the central law for co-operative societies whose members and objects spread across more than one state. Registration is with the Central Registrar of Co-operative Societies, not a state registrar. The Act was amended in 2023, mainly on elections and registration timelines.
Why the Act matters
A co-operative that serves members in two or more states can’t sit under one state’s law. This Act gives it a single central framework. If you are planning one, our team handles multi-state co-operative society registration end to end.
What the Act covers
- Registration of societies whose main objects serve members in more than one state.
- Bye-laws, which must aim at the members’ social and economic betterment through self-help and mutual aid.
- Board structure, general meetings and audit.
- Elections, now run through a Co-operative Election Authority after the 2023 amendment.
Key points to know
- Under the Act, the application is signed by at least 50 individuals from each state, or by at least 5 societies registered in different states, or a mix that covers two or more states.
- The elected board can have up to 21 members, with representation rules for scheduled castes or tribes and for women directors.
- The board must call the annual general meeting within six months of the financial year end, where accounts, audit report and profit use are taken up.
Credit societies and thrift groups often choose this route when they want to work across borders. Our guide to credit co-operative society registration explains the options, and a society can run its records on multi-state co-operative society software once it is live.
Common mistakes
- Registering under a state Act when members clearly come from several states.
- Bye-laws copied from another society without checking the objects.
- Missing the six-month window for the annual general meeting.
- Not keeping member lists state-wise at the time of application.
