Ballabgarh · Brand protection

Trademark Registration in Ballabgarh

In Ballabgarh a brand often belongs to a family, not one person: a sweet shop’s name, a flour mill’s packet, a part maker’s logo stamped for decades. Registering it settles who owns it before anyone else, inside or outside the family, files first. Haryana applicants are dealt with by the registry office in Delhi, and the national steps are on our main trademark registration page.

What it is

Registration makes a brand name, logo or tagline yours alone for the goods or services it covers. Protection runs for ten years at a time, with no limit on renewals.

It works under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. The application is Form TM-A, filed online with IP India. Which registry office deals with it depends on your principal place of business, and for anyone based in Haryana, Ballabgarh included, that office is Delhi.

Who it applies to

Family businesses with one shared name

A shop name used by two or three branches of the same family. Without registration, each branch has an equal claim the day the business splits.

Flour, spice and grain brands

Atta, besan, spices or namkeen sold in packets under a local name sit in Class 30. Raw grains and seeds sold under a mark sit in Class 31.

Part makers with their own mark

Units around Sector 58 and 59 that stamp a name on machine parts (Class 7), vehicle parts (Class 12) or metal hardware (Class 6).

Family brands: decide the owner before you file

In a family business the name tends to belong to everyone and no one. That works until the business divides. Then two brothers trade under the same name from shops a few hundred metres apart, and whoever filed first sits in the stronger position.

So the first question is ownership, not the logo. The application can be in one family member’s name or in the name of the firm or company that runs the business. We usually suggest a short written family understanding on who owns the mark and who may use it, signed before filing.

Moving a proprietorship into a company later? The mark is assigned to the company and recorded through Form TM-P; our guide to proprietorship to private limited explains the rest. Before any filing, we run a trademark search by word, sound and device, because a local name that sounds like an existing mark in Hindi can fail even when spelt differently.

How it works

1

Settle who owns the name

We talk through the family position and decide whose name the application goes in.

2

Search and choose the classes

We check the register for look-alikes and map what you sell to classes. In practice, most shops need one or two, not five.

3

File TM-A and start using ™

The application number comes through on filing day, and ™ can go on packets and boards from then.

4

Handle examination and publication

We reply to the examiner’s report, appear at any hearing, and watch the four-month opposition window after advertisement.

Timelines

Reply to an objection

You get one month from receiving the examiner’s report; silence can lead to the application being treated as abandoned.

Opposition window

Once the mark appears in the Trade Marks Journal, third parties have four months to oppose it.

Renewal

Due every ten years. File in the last six months before expiry to avoid the surcharge for late renewal.

What happens if someone files first

A relative or ex-dealer owns it

A family member or former distributor who files first can block your own later application.

Only passing off is left

Without registration you must prove reputation in a passing-off case, which is slower than an infringement suit.

® is not an option

Section 107 of the Trade Marks Act makes it an offence to pass off an unregistered mark as registered.

Frequently asked questions

Which registry office will deal with my Ballabgarh application?

Delhi. The registry’s Delhi office covers Haryana, and the deciding factor is your principal place of business, not your agent’s address. Since filing, replies and most hearings are online today, a trip to Delhi is rarely needed. We keep every date and notice in our diary and send you a copy of each.

What is the government fee for a trademark?

Filing TM-A online costs ₹4,500 a class if you are an individual, a recognised startup or a small enterprise, and ₹9,000 a class otherwise. Most Ballabgarh units with a micro or small Udyam certificate pay the lower rate. Paper filing is dearer at ₹5,000 or ₹10,000. You see our own fee in writing before anything is filed.

Our family shares the shop name. Who should apply?

The person or business that will control the brand should apply, and the rest of the family should agree to it in writing. Often that is the firm or company that runs the shop rather than any one member. Settling this before filing avoids a later fight over who owns the name and who may use it.

Can my proprietorship’s trademark move to our new company?

Yes, a trademark can be assigned to the company, and the assignment is recorded with the registry through Form TM-P. Use a written deed of assignment that covers the goodwill too. Even a pending application can be assigned and recorded. We handle this alongside the rest of the proprietorship-to-company move.

Which class covers a flour or spice brand?

Flour, besan, spices and similar processed foods fall in Class 30. Raw, unprocessed grains and seeds fall in Class 31, and packaged snacks such as namkeen may need Class 29 or 30 depending on the product. Each class carries its own fee. We read your product list and suggest only the classes you actually need.

When can I start printing ™?

From the day of filing. ™ only announces that you claim the mark, so no registration is needed for it. ® is different: it is reserved for registered marks, and using it early breaks Section 107. Many clients reprint packets and boards with ™ within a week, which quietly warns copycats off.

When will the certificate arrive?

If the examiner raises nothing and nobody opposes, expect roughly a year; objections and hearings stretch it. Four months of that is the opposition period after publication in the Journal. Once registered, your rights date back to the filing day, so the waiting period is covered too. That alone is a good reason to file early.

Do I need to come to your office?

No, the whole application can be handled online, with TM-48 signed digitally. If you would rather bring samples, old bills and packaging in person, our office is at B-363-365, Second Floor, BK Chowk, Faridabad, Haryana 121001, a short drive from Ballabgarh. It is open 24 hours, so pick a time when the shop or unit is shut.
