Trademark Registration in Delhi
Trademark applications from Delhi businesses are handled by the Trade Marks Registry’s Delhi office at Dwarka, whose jurisdiction covers the National Capital Territory. The government fee for e-filing Form TM-A is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others. Our main trademark registration page explains every stage; this page covers what Delhi brand owners should know.
What it is
A registered trademark gives you the exclusive right to use a name, logo or slogan for the goods or services you list, across India. It is granted under the Trade Marks Act, 1999, lasts ten years and can be renewed for ten years at a time.
You apply in Form TM-A on the IP India portal. Under Rule 4 of the Trade Marks Rules, 2017, the application belongs to the registry office covering your principal place of business. For a Delhi business that is the Delhi office, at Boudhik Sampada Bhawan, Plot No. 32, Sector 14, Dwarka, New Delhi-110075. The full process is on our trademark registration service page.
Old Delhi brands and the prior-use date
Delhi has many family businesses whose names are older than the owners: sweet shops, spice merchants, jewellers and cloth houses that have traded under one name for decades without filing. If that is you, the date of first use is your strongest card. In TM-A you can claim use from a past date and back it with a user affidavit and evidence such as old bills, letterheads, advertisements or account books.
Here is the catch: family brands often have more than one claimant. When brothers run separate shops under the same name in different markets, the question of who owns the mark should be settled in writing before filing, with a family settlement or an assignment. An application filed by one branch alone often leads to an opposition from another. We help you get the ownership in writing first.
A search comes before any of this. We check the IP India public search for the word, its spelling and phonetic variants, and logo elements, class by class. Our trademark search service covers that step on its own if you only want a check before deciding.
Who it applies to
Sweet shops, spices and food brands
Think of a Khari Baoli spice merchant moving into packed masalas: Class 30 covers spices, sweets and namkeen, and Class 43 applies if there is a restaurant too.
Jewellers and garment houses
Karol Bagh jewellers file in Class 14, and Gandhi Nagar or Chandni Chowk garment brands in Class 25 for clothing.
Startups and exporters
App and SaaS teams in Okhla or Nehru Place use Classes 9 and 42; exporters protect the brand they put on goods in the relevant goods class.
Why it matters
Stop copies in the same market
Look-alike names appear fast in busy markets. A registration lets you act against a confusingly similar one.
Settle family ownership
A registered mark in the right name avoids disputes when the business is split or handed down.
Sell online with confidence
Marketplaces act faster on copycat listings when you show an application or registration.

How it works
Search and settle ownership
We search the register, confirm who will own the mark, and fix the classes.
File TM-A with the Delhi registry
We file online and you receive the application number the same day; you can start using the ™ symbol.
Answer the examination report
If the examiner objects, we draft the reply and represent you at the hearing, if one is fixed.
Clear the Journal and register
The mark is advertised in the Trade Marks Journal; if no one opposes within four months, it proceeds to registration.
Timelines
Application number
Generated as soon as the online filing goes through.
Opposition window
Four months from the date of the Journal that advertises your mark.
Validity
Ten years from the application date, then renewable for ten years at a time under Section 25.
What happens if you don’t register
Someone else registers it
A competitor or a relative can file a similar name first and send you a notice.
Only passing off to rely on
Without registration you must prove reputation through a passing-off case, which is slower and costlier.
Non-use removal
Even a registered mark unused for five continuous years can be removed under Section 47.
Frequently asked questions
Which trademark office handles applications from Delhi?
The Trade Marks Registry office at Delhi handles them. It sits at Boudhik Sampada Bhawan, Plot No. 32, Sector 14, Dwarka, and its jurisdiction covers the National Capital Territory of Delhi along with Haryana, Punjab, Uttar Pradesh, Himachal Pradesh, Uttarakhand, Jammu and Kashmir and Chandigarh. Filing is online, so you do not need to visit the office in Dwarka.
What is the government fee?
The fee for e-filing Form TM-A is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others. Physical filing costs ₹5,000 and ₹10,000. A Delhi trader with a Udyam certificate qualifies for the lower rate by attaching it. The fee is the same everywhere in India, and each extra class costs the same again.
Our shop has used its name since the 1980s. Can we still register it?
Yes, and you can claim the date of first use. In TM-A you state the date from which the name has been used and file a user affidavit with evidence, such as old bills, account books, packaging or newspaper advertisements. A well-proved early use date helps you against anyone who filed later. We help you pick the earliest date you can actually prove.
Two branches of our family use the same shop name. Who should file?
The person or entity that the family agrees owns the brand should file. Settle that in writing first, with a family settlement, a deed of assignment or a licence to the other branch. If one branch files alone, another can oppose within four months of advertisement. A clear agreement before filing saves years of litigation, and we help you prepare it.
Which class should a sweet shop or restaurant choose?
Sweets, namkeen, spices and tea fall in Class 30, while restaurant and catering services fall in Class 43. A Chandni Chowk sweet brand that sells boxes online and also runs a dining hall would usually file in both. Packaged snacks may need Class 29 or 30 depending on the product. We match classes to what you actually sell.
Can I use the ® symbol after filing?
No, ® is only for registered marks. After filing you may use ™ to show you claim the brand. Using ® on an unregistered mark is treated as falsely representing a mark as registered, which is an offence under the Trade Marks Act. Switch to ® once the registration certificate is issued, and keep using ™ until then.
What if the examiner objects?
You file a written reply, and if the examiner is not satisfied, a hearing is fixed. Most objections cite Section 9, for descriptive or non-distinctive marks, or Section 11, for similarity with an earlier mark. In practice, evidence of long use in Delhi markets often carries an old brand through. We draft the reply and attend the hearing on your behalf.
Do I need to come to your office?
No. Delhi clients send the logo, details and signed TM-48 by email, and we file online the day the papers are ready. If you would like to meet, our only office is at B-363-365, Second Floor, BK Chowk, Faridabad, Haryana 121001, about 30 km from central Delhi. Our line, +91 93117 95484, is answered 24 hours.
