What it is

A registered trademark gives you the exclusive right to use a brand name, logo or slogan for the goods or services it is registered for. Registration lasts ten years and can be renewed again and again.

The law is the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. You apply in Form TM-A on the IP India portal. Each registry office covers a territory, and the Delhi office handles applicants whose principal place of business is in Haryana, Delhi, Punjab, Himachal Pradesh, Uttar Pradesh, Uttarakhand, Jammu and Kashmir or Chandigarh.

Who it applies to

Manufacturers selling under a brand

Auto-part, machinery, electrical and packaging units in Faridabad’s industrial sectors whose product name is stamped on boxes that travel across India.

Shops, restaurants and sweet houses

Local names built over years in NIT, Old Faridabad or Ballabgarh, often copied by a newcomer a few kilometres away once they become popular.

Startups and online sellers

Founders selling on marketplaces that ask for brand proof, and anyone raising funds, since investors check what the company owns.

Why it matters

Stop copycats in court

A registered owner can sue for infringement. Without registration you rely on passing off, which needs proof of reputation and is slower.

Lock in your filing date

Once registered, protection counts from the application date. Filing early beats a competitor who files after you.

Turn the brand into an asset

A registered mark can be licensed to a distributor, assigned on sale of the business, or shown to a bank as part of what you own.

Before you file: search and class

Most refusals start with a similar mark already on the register. So we search the IP India database by word, phonetic match and device before you spend on filing. A name that sounds the same in Hindi as an existing mark is a problem even if the spelling differs.

Next comes the class. There are 45 classes under the Nice Classification: 1 to 34 for goods and 35 to 45 for services. A Faridabad maker of vehicle parts usually files in Class 12, a garment exporter in Class 25, a restaurant in Class 43. Here is the catch. A Ballabgarh sweet shop that also sells packed namkeen and runs a small dine-in may need Class 30, Class 29 and Class 43. Each class has its own fee, so we file only where you trade or will soon.

You can do all of this with us online. If you prefer to sit across a table with your logo files and product samples, come to B-363-365, Second Floor, BK Chowk. The office is open 24 hours.

How it works

1

Search the register first

We run a public trademark search and give you a written view on similar marks in your class.

2

File Form TM-A online

We file online with a precise specification of goods or services. You get an application number the same day and can start using ™.

3

Answer the examination report

An examiner checks the mark. If there is an objection, we draft the reply and attend the hearing if one is fixed.

4

Clear publication and get registered

The mark is advertised in the Trade Marks Journal. If nobody opposes within four months, the certificate follows and you can use ®.

Timelines

Reply to objection

One month from receipt of the examination report, or the application can be treated as abandoned.

Opposition window

Four months from the date the mark is advertised in the Trade Marks Journal.

Renewal

Every ten years. Renewal can be filed in the six months before expiry; a later renewal costs a surcharge.

What happens if you do not register

Someone else files first

It happens more than you would think: a former distributor files your brand in his own name, then objects when you try to register it.

Marketplaces block you

Brand registries on e-commerce sites usually ask for an application number or registration certificate.

Using ® is an offence

Showing a mark as registered when it is not is punishable under Section 107 of the Trade Marks Act.

Frequently asked questions

Which trademark office handles applications from Faridabad?

The Delhi office of the Trade Marks Registry handles Faridabad, because its territory covers Haryana. The office is decided by your principal place of business in India, not by where your agent sits. Filing, replies and most hearings now happen online, so you do not need to travel to Delhi. Notices reach you by email and on the portal, and we track every date for you.

How much does trademark registration cost?

The official fee for Form TM-A is ₹4,500 per class for an individual, startup or small enterprise filing online, and ₹9,000 per class for everyone else. A Faridabad unit registered on Udyam as micro or small usually qualifies for the lower fee. Physical filing costs ₹5,000 or ₹10,000. Our professional fee is added and quoted before you commit.

Can I use the ™ symbol right after filing?

Yes, you can use ™ as soon as the application is filed, because it only says you claim the mark. The ® symbol is allowed only after the registration certificate is issued. Using ® earlier is an offence under Section 107. Most Faridabad clients start printing ™ on packaging the week we file.

How long does trademark registration take?

An application with no objection and no opposition can be registered in about a year; objections, hearings and oppositions add time. The Journal alone needs a four-month opposition window. Protection counts from your application date, so the wait does not leave you exposed. In practice, filing early is the one thing that strengthens your position, whatever the wait.

My shop name is common in Faridabad. Can I still register it?

Possibly, if it is distinctive enough or combined with a distinctive logo. Descriptive words like “Fresh Sweets” or a plain surname are hard to register alone. We search the register first and suggest changes, such as adding a coined word or a device. A strong logo mark often clears where the plain word would not.

Do I need to register in more than one class?

Only if you sell goods or services that fall in more than one class. A machine maker in Class 7 that also offers repair services may need Class 37 as well. Each class is charged separately: ₹4,500 or ₹9,000. We map what you actually sell today and plan to sell soon, and file only where it matters.

What if the examiner objects to my trademark?

You reply in writing within one month of receiving the examination report, and many objections are cleared at this stage. Common grounds are similarity to an earlier mark or a descriptive word. If the reply is not accepted, a hearing is fixed, usually held online. We draft the objection reply with evidence of use and handle the hearing.

Can I meet you in person about my brand?

Yes, our office at B-363-365, Second Floor, BK Chowk, Faridabad is open 24 hours. Bring your logo files, old invoices and packaging, which help prove prior use. Clients outside Faridabad do everything online, with the authorisation signed digitally. Either way, the search report and filing copy come to you by email.
