What it is

A registered trademark gives you the exclusive right to use a name, logo or tagline for the goods or services you list. Anyone using a deceptively similar mark for those goods can be stopped in court.

Registration is under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017, filed in Form TM-A on the IP India portal. Under Rule 4, the right office depends on your principal place of business in India, and for Uttar Pradesh that is the New Delhi registry. Our trademark registration service covers the full journey from search to certificate.

Who it applies to

Electronics and accessory brands

Companies that design chargers, earphones, LED lighting or small appliances, often made by a contract unit in Phase II or Greater Noida and sold under their own label.

Garment exporters going domestic

Export houses in Sector 63 and Phase II that have stitched for overseas labels for years. Now they want a label of their own in India, and the name has to be cleared first.

Media, edtech and software firms

Studios near Film City, coaching platforms and SaaS teams in Sector 62 and 132 whose name is the product.

Why it matters

Guard against lookalike stock

The unit that makes your product also sees your packaging. Picture a Noida earphone brand finding near-identical boxes at a Delhi wholesale market. A registered mark lets you act quickly.

Get listed by distributors

Large retail chains and distributors often ask for the application number before listing a new brand.

Build an asset you can sell

A registered mark can be licensed, assigned or valued when you raise funds or sell the business.

Choosing classes for a Noida product brand

The Nice Classification has 45 classes: 1 to 34 for goods and 35 to 45 for services. Each class is a separate fee. Many Noida brands need two or three classes.

BusinessClasses usually considered
Electronic gadgets, chargers, cables, software productsClass 9
Lighting and small heating or cooling appliancesClass 11
Readymade garments and footwearClass 25
Online or retail store selling many brandsClass 35
SaaS, app development, IT servicesClass 42
Coaching, training, media contentClass 41

In practice, a Noida accessory brand that sells phone chargers and smart bulbs needs Class 9 and Class 11, not one. Describe the goods in plain words that match what you actually sell.

Documents required

The applicant

  • Name and address of the individual, firm or company
  • Certificate of incorporation, if a company
  • Udyam or DPIIT certificate for the lower fee

The mark

  • Brand name, or logo in JPG
  • Goods or services list
  • Date of first use, if already in use

Authority and proof

  • Form TM-48 authorising us as agent
  • User affidavit with invoices, if claiming prior use

How it works

1

Run a public search in each class

We search the IP India register for identical and similar marks, word, phonetic and device, before you commit. See our trademark search service.

2

File TM-A with the New Delhi registry

We file online and you get the application number the same day. From then on you can use ™ with the mark.

3

Reply to the examination report

If the examiner raises an objection under Section 9 or 11, we draft a written reply with evidence and attend any hearing.

4

Clear the journal and get registered

Once accepted, the mark is advertised in the Trade Marks Journal. If no one opposes within four months, the registration follows.

Timelines

Filing day

Application number on the day of online filing.

Opposition window

Four months from the date the mark is advertised in the Journal.

Validity

Ten years from the application date under Section 25(1), renewable for further ten-year terms.

What happens if you skip registration

A rival files first

Someone who files a similar mark before you can block your application and force a costly opposition or rebrand.

Harder to act on copies

Without registration you rely on passing off, which needs proof of reputation and is slower to enforce.

Non-use can cost you

Even after registration, a mark unused for five years can be removed on a third party’s application under Section 47.

Frequently asked questions

Which trademark office handles applications from Noida?

The Trade Marks Registry at New Delhi handles them. Its territory covers Uttar Pradesh along with Delhi, Haryana, Punjab, Himachal Pradesh, Uttarakhand, Jammu and Kashmir and Chandigarh. The office is decided by your principal place of business under Rule 4. Everything is filed online on the IP India portal, and hearings are usually held by video, so you seldom need to visit the registry.

What is the government fee for a trademark in Noida?

The fee for an online TM-A is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for other applicants. Paper filing costs ₹5,000 and ₹10,000. A Noida company with a Udyam certificate showing small-enterprise status, or DPIIT startup recognition, can claim the lower fee. We check eligibility and attach the proof so the right fee is paid.

We sell chargers and smart bulbs. How many classes do we need?

Usually two: Class 9 for chargers, cables and other electronic accessories, and Class 11 for lighting. If you also run your own online store selling other brands, Class 35 may be worth adding. Each class carries a separate fee of ₹4,500 or ₹9,000. We map your product list to classes before filing so nothing you sell is left out.

Our products are made by a contract manufacturer. Whose name goes on the application?

Your name or your company’s name goes on it, as the brand owner, not the manufacturer’s. The applicant should be whoever controls the brand and its quality. Put a clause in the manufacturing agreement confirming you own the mark and that the unit cannot use it for anyone else. File before you share final packaging, so your priority date comes first.

When can I use the ® symbol?

Only after the mark is registered and the certificate is issued. Until then, use ™ to show you claim the mark. Using ® on an unregistered mark is a false representation that is punishable under Section 107 of the Trade Marks Act. We tell you the day registration comes through, so you can update the packaging.

What if the examiner objects to our brand name?

You file a written reply, and many objections end there. Objections usually rest on Section 9, where the mark describes the goods, or Section 11, where it is similar to an earlier mark. The reply is due within one month of the examination report under Rule 33. We explain why the mark is distinctive, add evidence of use and appear at the hearing if one is fixed.

Do we have to come to your office?

No, the full process runs online for Noida clients. You send the logo and details by email or WhatsApp and sign the TM-48 digitally or on paper. Our office is in Faridabad, at B-363-365, Second Floor, BK Chowk, Faridabad, Haryana 121001, if you want to meet. Our line +91 93117 95484 is answered 24 hours, so call before you come.

We have used our brand since 2021. Does that help?

Yes, prior use helps. You can claim the date of first use in TM-A and back it with a user affidavit and dated invoices, packaging or advertisements. An earlier use date can win against someone who filed later, and it strengthens a reply to an objection. Collect whatever dated proof you have before we file, even old invoices from your first customers.
