What it is

A registered trademark gives you the exclusive right to use your brand name, logo or tagline for the goods or services you list, anywhere in India. It is granted under the Trade Marks Act, 1999, lasts ten years and can be renewed every ten years.

You apply in Form TM-A on the IP India portal. Rule 4 of the Trade Marks Rules, 2017 sends the application to the registry office covering your principal place of business, and for Haryana that is New Delhi. The steps, fees and objections are explained on our trademark registration service page.

Who it applies to

Startups with an app or platform

A Gurugram SaaS or consumer app founder usually needs Class 9 for downloadable software and Class 42 for software as a service.

Cafés, restaurants and D2C brands

Food outlets on Golf Course Road or in Sector 29 file in Class 43. Clothing and personal care brands file in their goods classes, such as 25 or 3.

Consultancies and training firms

Business consulting sits in Class 35 and coaching or training in Class 41, both common among Gurugram service firms.

Why it matters

A crowded market

Gurugram startups compete for the same short, catchy names. An early filing date carries weight in a dispute.

Investor due diligence

Funds check that the company, not a founder personally, owns the brand. An application in the company’s name settles that.

Marketplace takedowns

Online marketplaces and app stores act faster on copycat listings when you show a trademark application or registration.

Search before you file

Most refusals start the same way: a name too close to an existing mark. Before filing, we search the IP India public search for the word, its phonetic variants and the logo elements, one class at a time. If the register is crowded, we suggest changes before you file.

Picking classes needs the same care. The Nice Classification has 45 classes: 1 to 34 for goods and 35 to 45 for services. A Gurugram fintech app might need Classes 9, 36 and 42, while a co-living brand might need 43 and 36. Each class is a separate fee, so we file only where you trade or genuinely plan to. Our trademark search service covers this step on its own if you only want a check.

  • Certificate of incorporation, if a company or LLP
  • Udyam certificate or DPIIT recognition, for the lower fee

The mark

  • Brand name exactly as used

Authority

  • Form TM-48 power of attorney signed by the applicant
  • List of goods or services you sell

How it works

1

Search the register and pick classes

We run the search, recommend the classes and draft the specification of goods or services.

2

File Form TM-A

We file online with the New Delhi office. You get an application number the same day and can use the ™ symbol.

3

Reply to the examination report

If the examiner raises an objection, we draft the reply and attend the hearing where one is fixed.

4

Get through the opposition window

The mark is advertised in the Trade Marks Journal. With no opposition in four months, it proceeds to registration.

Timelines

Application number

Issued as soon as the online filing goes through.

Opposition period

Four months from the date of the Trade Marks Journal that advertises your mark.

Validity

Ten years, then renewable for ten years at a time under Section 25.

What happens if you don’t register

Someone else files first

A competitor who registers a similar mark can send you a notice and force a costly rebrand.

Weak enforcement

Without registration you rely only on a passing-off claim, which needs proof of reputation built over time.

Non-use risk

A registered mark unused for five continuous years can be removed under Section 47, so file for what you actually use.

Frequently asked questions

Which trademark office handles applications from Gurugram?

The Trade Marks Registry office at New Delhi does. Its territorial jurisdiction covers Haryana along with Delhi, Punjab, Uttar Pradesh, Himachal Pradesh, Uttarakhand, Jammu and Kashmir and Chandigarh. Rule 4 links the office to your principal place of business in India. Filing is fully online, so you never need to visit the office, but hearings and correspondence come from New Delhi.

What is the government fee for a trademark in Gurugram?

The fee is ₹4,500 per class for e-filing by an individual, a startup or a small enterprise, and ₹9,000 per class for everyone else. Physical filing costs ₹5,000 and ₹10,000. A Gurugram company with a Udyam certificate or DPIIT startup recognition gets the lower rate if it attaches the proof. The fee is the same everywhere in India.

Should the trademark be in my name or my company’s name?

Put it in the name of the entity that runs the business, usually the company. Investors and acquirers check this, and moving a mark later needs an assignment and a fresh filing with the registry. If you file before incorporating, you can file in your own name and assign it to the company afterwards. We help you pick the cleaner route.

Can I use the ® symbol after filing?

No, the ® symbol is only for registered marks. Once your application is filed you can use ™ to show that you claim the brand. Using ® on an unregistered mark is treated as falsely representing a mark as registered under the Trade Marks Act. Switch to ® only after the registration certificate is issued.

How many classes does a Gurugram tech startup need?

Usually two to start: Class 9 for downloadable software and apps, and Class 42 for software as a service and IT services. Fintech, edtech or health apps often add the class for that industry, such as 36, 41 or 44. Each class is a separate fee. In practice we match classes to your product roadmap, not to every class that sounds related.

What if the examiner objects to my mark?

You file a written reply, and if needed the registry fixes a hearing. Most objections cite Section 9, for a descriptive or non-distinctive mark, or Section 11, for similarity with an earlier mark. A reasoned reply with evidence of use often clears them. We draft the reply and appear at the hearing for you.

Do I need to come to your office to file?

No. Gurugram clients send the logo, details and signed TM-48 by email, and we file online the same day the papers are ready. If you want to discuss your brand face to face, visit us at B-363-365, Second Floor, BK Chowk, Faridabad, Haryana 121001. Our line, +91 93117 95484, is open 24 hours.

Can I trademark a name I have already started using?

Yes, and file soon. Think of a Sector 29 café that has traded under its name for two years without filing: anyone who files first can make life hard for it. In TM-A you state the date of first use and support it with an affidavit and evidence, such as dated invoices, website pages or social media posts. An earlier use date can help you in a dispute with someone who filed later. If you have not launched yet, file on a “proposed to be used” basis instead.
